By downloading, installing, or using the Sparkful Games mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.
Sparkful Games reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
The App is intended for use by individuals aged 13 years or older. By using the App, you represent and warrant that:

Subject to your compliance with these Terms, Sparkful Games grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial entertainment purposes only.

Certain features of the App may allow you to submit, post, or share content ("User Content"). By providing User Content, you grant Sparkful Games a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with the App and Sparkful Games' business.
You represent and warrant that: (i) you own all rights to your User Content, or have obtained all necessary permissions to grant the license above; and (ii) your User Content does not violate any third-party rights or applicable laws.
Sparkful Games reserves the right to remove any User Content at its sole discretion without notice.
All intellectual property rights in the App, including but not limited to copyrights, trademarks, trade secrets, patents, and any other proprietary rights, are owned by Sparkful Games or its licensors.
Nothing in these Terms grants you any right to use any of Sparkful Games' trademarks, service marks, or logos.
The App is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Sparkful Games does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Sparkful Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use or inability to use the App.
Sparkful Games may terminate your license to use the App at any time, with or without cause, by providing you with notice. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and disclose your information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
